The Mare keeps the foal.

Just like in real life, the mare owner pays a stud fee to use the stallion to produce a baby, and the mare (rather, the owner of the mare) keeps the baby.

In game, stallion owners can make agreements with mare owners to buy the offspring after birth, but there is no legally way to FORCE a mare owner to sell you the baby.

Unless as lexi stated above you have made a deal with the stallions owner. I know because I just did that with one of my paint mares.

As said above, the owner of the mare keeps the foal when it is born unless it is sold back to the owner of the stallion. The owner of the stallion will not be able to affix the foal, just own it so its kind of pointless to buy the foal after its born to the second owner
